Student athlete status in Portugal: rights and who qualifies
Student athlete status in Portugal exists only in higher education; school-age swimmers use different laws. It gives priority in class scheduling, excuses official competition absences, and allows requests to move tests or use special exam periods. Three eligibility tests apply together.
Idea in Brief
- The named statute starts in higher education. Schools use different laws.
- Three tests apply together. The swimmer must meet the competition, sporting merit and study rules.
- The rights cover study clashes. Local rules explain how to apply.
At the kitchen table, you search the school website for an Estatuto do Estudante-Atleta form. The school office has no form either. There is one status with that name in Portuguese law. It exists only in higher education. This was how the law stood in September 2026. Decreto-Lei n.º 55/2019, de 24 de abril created the Estatuto do Estudante-Atleta do Ensino Superior. That means higher education student-athlete status. A Juvenis swimmer in the 10.º ano cannot claim it.
School-age swimmers use different rules. Decreto-Lei n.º 272/2009 covers swimmers on the IPDJ alto rendimento register. This is the high-performance register. Decreto-Lei n.º 45/2013 covers regular national-squad swimmers. Portaria n.º 275/2019 covers UAARE schools. At university, artigo 2.º sets three cumulative tests. The student must race in a competition listed in artigo 3.º. They must meet the sporting merit rule in artigo 4.º and the study rule in artigo 5.º. All three apply at once. This is the legal detail behind the support noted in the Seniores and Sub-21 guide.
Artigo 3.º gives several routes. One is racing for the university, its students’ union or a national university team. This includes campeonatos nacionais universitários, the national university championships run by FADU. University meets run by the European University Sports Association or International University Sports Federation also count. Another route is the latest federation meet for a national title. European and world title meets count too. A third route covers registered university athletes who raced at national or international school championships in the prior study year. A university may add regional meets, university qualifiers and federated athletes.
For swimming, artigo 4.º sets a placing for the two national championship routes. The swimmer must finish in the primeiro terço da tabela classificativa. That means the first third of the results table. An entry or qualifying time is not enough. The national school championship route has the same first-third test. Then comes artigo 5.º. The student must have passed 36 credits in the prior academic year. If enrolled in fewer than 36, they must pass them all. This test does not apply during the first year of a cycle of studies. A university cannot relax it.
Artigo 7.º sets the minimum rights. The swimmer gets priority when choosing class times that fit training, once the need is shown. Relevação de faltas means absences caused by official competitions are excused. The student can ask to move a formal individual test that falls on those competition days. They may also ask for at least two exams each year in an época especial. This is a special exam period.
The status starts when granted and lasts at least one year. Artigo 8.º leaves the application, renewal, length and responsible office to each university or polytechnic’s own rules. Those rules may offer wider rights or more routes. They cannot lower the credits test.
Share it with your swimmer
Keep the legal detail matched to their stage:
- Under 12 (you’re driving). “At school, we need to ask which school rule applies.” This keeps the request under the right law.
- 12–15 (sharing the wheel). “This status starts in higher education, but school support has other names.” This separates future rights from current support.
- 16+ (they’re driving). “Check your meet, placing and credits before you apply.” This gives them the three tests to verify.
Stay aligned with your coach
The coach can identify the official competition and placing. You can help your swimmer find the university’s rules. Ask, “Which meet and result should they use for the request?” Read that institution’s regulation, and ask the sports service or the students’ association, because the decree is only the floor.
